Civil litigation is a legal process involving a dispute between two parties that isn’t based on criminal actions. This means that a civil litigation case does not involve criminal charges and penalties. Typically, in civil litigation, one party, referred to as the plaintiff, is usually seeking compensation or some other remedy from another party, referred to as the defendant. This dispute can be resolved either through negotiations or through the court system. A civil case can involve an individual against an individual, an individual against a business, a business against another business, an individual against a government entity, and so on.
When a civil dispute is taken to trial, the standard of proof is usually less strict than in criminal litigation. In a criminal trial, the prosecutor is required to present convincing evidence and prove their case beyond a reasonable doubt in order to prevail. However, in civil litigation, the party that prevails is the one that presents more convincing evidence than the other.
